In the two preceding parts of this article, the refusal to admit the Greenlandic football association to UEFA and CONCACAF served as a point of departure to outline the constitutional structure of world football more generally and to critically examine the territorially based criteria for the admission of national associations to international federations as laid down in positive association law. Building on that foundation, the present and concluding Part 3 explores how domestic, supranational, and international law may exert a modifying influence on the positive constitutional law of sports governing bodies. It examines, in particular, whether and how national associations from autonomous territories — most notably the Greenlandic football association — can and, where appropriate, must be admitted to a confederation and, in the longer term, to FIFA.

  • Zulässigkeit von „Partial Bans“ bei Online-Computerspielen? (P. S. Fischinger / M. Maties, S. 533)

The article examines the legality of partial bans in online video games, using the example of a transfer market ban in EA Sports FC 25’s Ultimate Team mode. A partial ban restricts a player’s access to certain game features without completely excluding them from the game. The article explores whether such bans can be unilaterally imposed by a game publisher as part of a long-term contractual relationship. It discusses the legal framework under German law, considering whether a partial ban can be justified without an explicit contractual agreement. The article concludes that without a specific contractual provision allowing for a partial ban, such actions are not legally permissible. It further analyzes whether EA could include a valid clause in its user agreement to impose a transfer market ban for certain trading practices. The authors argue that even if EA amended its user agreement to include such a clause, it might not withstand legal scrutiny under § 308 Nr. 4 BGB due to the lack of a legitimate interest and the potential impact on users. Ultimately, the article suggests that current transfer market bans in EA FC 25 are unlawful and that future attempts to enforce them may face significant legal challenges.

The Self-Determination Act came into force on 1 November 2024. Since then, intersex, trans and nonbinary people have been able to change their gender as recorded in the civil status register by self-declaration. This considerable liberalisation corresponds to the question of the legally binding nature of such declarations, especially for sport. This article examines § 6 SBGG and categorises the extent to which its regulatory content makes changes to the gender entry in the civil status register legally binding for sports clubs and associations and what practical consequences result from this.

Sports are increasingly subject to regulation under European competition law. This article underscores the importance of market definition, a fundamental concept in competition law, which traditionally centers on consumer demand. It discusses that recent cases have adopted a structural approach to defining markets, emphasizing abstract concepts such as the organization, exploitation, and marketing of interclub football competitions. This shift risks overlooking the realities of consumer behavior and demand, potentially leading to market definitions that diverge from consumption realities.

  • Betroffene des DDR-„Zwangsdopings“: Tatsachenermittlung und geforderter Kausalitätsnachweis im sozialen Entschädigungsrecht (J. Buhrmann, S. 556)

Although the state doping system of the GDR can be considered as comprehensively clarified and the health damage caused by it is known and can be traced in its causal context, the number of doping victims who receive social compensation benefits is strikingly low. According to the regulations, the current state of scientific knowledge or applicable doctrine must be taken into account when establishing facts and proving causality.It is highlighted that decision-makers are not complying with this. Instead, unfounded, factual evidence is required or existing causal relationships are denied. Those affected are clearly identifiable as a group in quantitative and qualitative terms. Many live in extremely precarious circumstances. Due to their advanced age, training decision-makers to reach the level of decision-making required by the regulations seems too long. A suitable solution appears to be for the legislature to consider the victims of state doping in the GDR as beneficiaries within the framework of the administrative rehabilitation law.

  • Nochmals Union gegen Bochum: Wer ist für den „faktischen Spielabbruch“  verantwortlich? (S. Dittl, S. 562)

The article discusses the legal aspects surrounding the de facto abandonment of a Bundesliga match between Union Berlin and VfL Bochum. The incident involved a Union Berlin fan throwing a lighter at Bochum’s goalkeeper, leading to his inability to continue playing. Despite Bochum’s request to abandon the match, the referee did not comply, resulting in a mutual nonaggression pact between the teams for the remaining minutes. Bochum later contested the 1:1 match result, seeking a 2:0 victory. The DFB Sport Court, DFB Federal Court, and Permanent Court of Arbitration for Licensed Leagues all ruled in favor of Bochum, citing the need for general prevention against fan misconduct. The article critiques these decisions, arguing that the legal basis for such rulings is not convincingly supported by existing regulations, in particular not by § 17 of the DFB’s legal code. It suggests that the nonaggression pact, which led to a de facto match abandonment, should have resulted in a 0:2 loss for both teams under § 18 Nr. 4 of the DFB’s legal code.
